A Hoople, N.D., man is accused of raping a woman he knew.
Robert Edward Curry, 32, could spend up to 20 years in prison if convicted of gross sexual imposition.
An affidavit for his arrest said the alleged victim, who is referred to only as "Jane Doe," was drinking at an event in Hoople Friday night and into Saturday morning. She had arranged to stay at Curry's home that night with a friend, the affidavit said.
Hoople is about 65 miles northwest of Grand Forks.
The woman allegedly told police she was highly intoxicated and fell asleep sitting up on Curry's couch. Her friend fell asleep on another section of the couch and the affidavit said Curry moved Doe into a lying position on the couch. He tried to move her again later and she resisted, but Curry forcefully rolled her onto her back, pushed her dress up and raped her, the affidavit said. She didn't say or do anything because she was in shock, according to the affidavit.
Investigators served Curry with a search warrant and he told them, "from what I remember I was drinking and having fun. ... She took her clothes off. ... I didn't do anything. I didn't force anything," according to the affidavit.
Curry appeared in court Monday.
