A 29-year-old Superior, Wis., man worried about getting caught for a probation violation broke his back to avoid being caught -- literally.
Eric M. Fairbanks jumped out a second-story apartment window instead of submitting to a breathalyzer test Nov. 19, according to a Superior police report.
When a Douglas County Jail officer stopped by Fairbanks' second-story apartment for a home check, he attempted to get a reading with a portable breathalyzer. According to the report, one of the conditions of Fairbanks' probation is he cannot consume alcohol. Instead of giving the sample, Fairbanks went into another room, opened the window and jumped to the ground.
When Officer Kirk Babic responded to the back of the apartment complex, Fairbanks came crawling out from the garage on his hands and knees.
Fairbanks was transported by ambulance to St. Luke's hospital in Duluth. The report states that Fairbanks broke his back as a result of the fall.

In addition, Babic wrote, the jail officer informed him Fairbanks had violated his probation and, after his release from the hospital, should be lodged in jail.
