Toxicology report: Bicyclist drunk before fatal Fargo accident

Toxicology reports indicate an Osage, Minn., man was drunk when he was killed in a bicycling accident in Fargo in May, Fargo Police Sgt. Jeff Skuza said today.

Gordon Fineday, 48, died after he struck a metal gate along a bike path at Fargo's Dike East during the early morning hours of May 29.

Skuza said Fineday had a blood alcohol concentration of 0.21 percent. North Dakota's legal limit for operating a vehicle is .08 percent.

The metal gate Fineday hit was designed to prevent vehicle traffic from accessing the bike bath.

After the accident, it was removed at the recommendation of the Fargo Park District's insurance company.
