Minnesota man accused of strangling his brother during an argument over father

A 55-year-old Breezy Point man is accused of attempting to choke his brother during an argument about the care of their elderly father, court documents stated.

A 55-year-old Breezy Point man is accused of attempting to choke his brother during an argument about the care of their elderly father, court documents stated.

Bryan Blaine Johnson was charged Jan. 7 in Crow Wing County District Court with felony domestic assault by strangulation, gross misdemeanor of obstructing the legal process with a peace officer and misdemeanor domestic assault with attempt to inflict bodily harm.

Johnson's next court date, an omnibus hearing, is scheduled at 1:30 p.m. March 8. Conditions of release were set for Johnson, who currently is not in Crow Wing County Jail, and include he cannot enter the victim's residence, cannot leave the state without written court consent, cannot possess a firearm, cannot possess or use alcohol or controlled substance and he is subject to random testing.

According to the probable cause filed against Johnson:

• At 7:39 p.m. Jan. 6, law enforcement was dispatched to a physical fight in Breezy Point between two adult brothers. An officer arrived at the residence and made contact with the victim. The victim, who had an abrasion to his left eye, said he and his brother, Johnson, were arguing about the care of their elderly father when Johnson attacked him. The victim stated Johnson put his hands around his neck and attempted to choke him, the document stated. The victim said he felt threatened and fought back until he could control the defendant. The officer observed slight redness on the victim's neck and minor abrasions on his hands in addition to the mark by his eye. The victim could not remember if his breathing had been impeded, but stated, "he was trying to," the document read.

• The officer made contact with Johnson in the living room. The officer observed Johnson's hands balled up into fists and noted he had a sheath on the right side of his belt that possibly contained a knife, the document read. The officer also noted blood on the floor and on Johnson's pants and face. The officer removed a multi-tool with a blade from the sheath and attempted to conduct a pat search of the subject for additional weapons. When the officer attempted to control Johnson's right hand he pulled away and moved toward a table which held a large folding knife. The officer pulled Johnson away and told him to put his hands behind his back and he struggled and pushed the officer, the document read. Fearing Johnson may become more combative or attempt to get a weapon, the officer attempted to take Johnson to the ground. The officer displayed his chemical irritant spray and advised Johnson if he continued to resist he would be sprayed. Johnson continued to struggle and attempted to get away until he was taken to the ground.
