WALKER, Minn. -- A 44-year-old man was given the maximum sentence after he strangled someone in front of a child.

Dallas Wayne Smith, Cass Lake, was found guilty of the felony crime of domestic assault by strangulation after a two-day trial in June in Cass County District Court in Walker. The jury convicted Smith of the strangulation charge, along with a misdemeanor domestic assault charge.

Judge Jana Austad departed from the standard sentence, instead giving the maximum sentence of three years in prison for this type of offense. The jury found the defendant committed the acts in the presence of a child and had inflicted injury on the victim when he had previously been convicted of criminal sexual conduct, the Cass County Attorney's Office reported.

Smith was on supervised and conditional release from prison at the time of the crime, which occurred March 23 in Cass Lake.
