FARGO – A man who has been held in the North Dakota State Hospital in Jamestown since being accused of stabbing his wife to death in their Fargo apartment in March 2012 is set for a new hearing in the case.
Henry Leo Deniger, 52, was found not guilty in April 2013 after a Cass County judge said he couldn’t be held criminally responsible for his acts.
Prosecutors said Deniger stabbed his 52-year-old wife, Kathye, in their apartment, then washed off the knife in the kitchen sink.
Deniger was found the next day at a St. Cloud, Minn., McDonald’s, where he allegedly confessed to killing Kathye Deniger.

A State Hospital forensic psychologist testified at last year’s hearing that Deniger had schizoaffective disorder/bipolar type, and antisocial personality traits, which she said influenced his behavior at the time of the stabbing.
Deniger was committed at that hearing to a year at the State Hospital to determine whether he would likely commit another crime as a result of his illness.
That commitment can be extended, the judge’s order states.
The order committing Deniger for a year states that the director of the State Hospital has to find out whether Deniger has an attorney to represent him at the upcoming hearing to review his commitment.
That hearing is set for Thursday.
