Gibbs found guilty of murder

BISMARCK - After deliberating for more than 20 hours over four days, a jury of five women and seven men has found Moe Gibbs guilty of murdering Mindy Morgenstern in September 2006.

BISMARCK - After deliberating for more than 20 hours over four days, a jury of five women and seven men has found Moe Gibbs guilty of murdering Mindy Morgenstern in September 2006.

Gibbs' will be sentenced during a hearing at 1 p.m. Dec. 17.

The Burleigh County jury received the case at 3:40 p.m. Tuesday after 11 days of testimony and arguments from attorneys that centered on DNA found on Morgenstern's left-hand fingernails and Gibbs' whereabouts the afternoon she was killed.

The state called 32 witnesses to testify against the former Barnes County jailer, including his ex-wife and Morgenstern's boyfriend.

The defense called four witnesses. Gibbs did not take the stand.

Gibbs, 35, faced a Class AA felony murder charge for the death of Morgenstern.

A jury in Minot deadlocked 6-6 in July over whether Gibbs strangled and cut the throat of the 22-year-old New Salem native on Sept. 13, 2006, in her Valley City apartment.

Gibbs was a Barnes County jailer and lived in the same building at the time of his Sept. 20, 2006, arrest. He faced a maximum sentence of life without parole if convicted.
