A Grand Forks man accused of kicking an officer in the leg over the weekend has been charged with felony assault.

James Michael Peters III, 20, appeared in state District Court on Monday, and his bail was set at $3,000.

At about 3:20 a.m. Saturday, an officer saw a 2001 Dodge Stratus abruptly change lanes two times on North Washington Street, according to a police report.

The officer stopped the car and arrested Peters, a passenger, on suspicion of underage drinking, the report states.

On the way to the Grand Forks County jail, Peters threatened to assault and kill the officer, the report says.

At the jail, Peters struggled with the officer who arrested him as well as a second officer; during the scuffle, Peters kicked the second officer, David Buzzo, in the leg, the report says.

Along with assault, Peters is charged with underage drinking, preventing arrest, possession of drug paraphernalia and terrorizing.

Sgt. Douglas Wright, who was not working when the incident occurred, did not know what injuries, if any, Buzzo suffered, but said he was scheduled to work Monday night.

Prosecutor Chris Griffin, who's handling the case, said the assault is a felony because the victim is an officer, not because his injuries were serious.

Peters has a preliminary hearing set for Dec. 20.
