A former member of the Phi Delta Theta fraternity who was arrested after a drug bust at the UND chapter's house was arraigned Tuesday.

Spencer Martin Miller, 19, is facing two charges of possession of marijuana with intent to deliver and a drug paraphernalia charge in Grand Forks County District Court.

The Nov. 8 bust in which eight members or pledges where either cited or charged caused Phi Delta Theta to suspend the UND chapter until fall 2013.

An affidavit said Miller sold marijuana to an undercover police informant, which led to the issuing of a search warrant.

The charge of possession of marijuana with intent to distribute is a Class B felony, punishable by as many as 10 years in prison and a $10,000 fine.
