Fargo police conclude 2 separate investigations into fatal car crashes

Fargo police say they've completed investigations into two fatal accidents and have forwarded the results to the Cass County State's Attorney's office, which will consider whether or not to file charges.

Autopsy results show 51-year-old Marcus Bearstail had a blood-alcohol level three to four times the legal limit for driving - between 0.24 and 0.36 - when he was hit by a car at 8:43 p.m. Oct. 8 while walking across 13th Avenue South between 40th and 42nd streets, not near a marked crossing, Sgt. Mark Lykken said.

The toxicology report wasn't completed yet for the driver of the 2000 Grand Prix that hit Bearstail, but Sgt. Joe Anderson said there were no obvious signs of alcohol and the driver consented to blood and urine tests. There also was no indication he was speeding Lykken said.

In the other unrelated investigation, an accident reconstruction determined that 23-year-old Ruben Perales of Fargo was driving between 93 and 108 mph when his southbound 2002 Chevy Impala crossed the median on South University Drive and struck a pillar at the Interstate 94 underpass at about 1:50 a.m. Oct. 17.

Witnesses reported that Perales was drag racing with another car, but the driver of the other car, who is Perales' brother, told police they weren't racing, Anderson said. Family members also told The Forum they weren't racing.

The full autopsy report isn't done in the Perales case. A preliminary autopsy report determined the cause of death to be blunt force trauma, Anderson said.
