MITCHELL, S.D. - The driver in a crash that killed a 14-year old boy had a blood alcohol content of 0.148 percent at the time of the incident, according to court documents.
Karla Martinez, 22, faces a status hearing on July 9 after being charged with third-offense driving under the influence, vehicular homicide, furnishing alcohol to a person under 18, driving with a suspended license, possessing an open container of alcohol and failure to use a seat belt. Vehicular homicide and third-offenses DUI are felonies.
Lenard Boyer, of Mitchell, died at 3:20 p.m. at Avera McKennan Hospital in Sioux Falls. None of the vehicle's four occupants were wearing seat belts, but Boyer was the only one ejected from the vehicle. He was initially transported to Avera Queen of Peace in Mitchell for head trauma, then was flown to Avera McKennan.
On June 25, Martinez lost control of her 2005 Jeep Grand Cherokee while driving south on 406th Avenue near an intersection with 252nd Street. After losing control of the vehicle, it entered a ditch and rolled several times.
Martinez was brought to Davison County Jail and bail was set at $20,000 in cash. For her third DUI offense, Martinez faces a maximum sentence of two years imprisonment in the state penitentiary and a fine of $4,000. For vehicular homicide, the maximum sentence is 15 years imprisonment and a fine of $30,000.

Martinez has also been charged with three misdemeanor offenses. For furnishing alcohol to a minor, the maximum sentence is one year imprisonment in a county jail a $2,000 fine. For driving with a suspended license and possession of an open container, both class two misdemeanors, Martinez could be sentenced with up to 30 days imprisonment in a county jail and a $5,000 fine for each offense.
