Moe Gibbs is appealing his conviction for the murder of Mindy Morgenstern, arguing there was not enough evidence to convict him and he did not receive adequate funding to put on an effective defense.
After two trials, a jury convicted him last year for the September 2006 murder.
The case is set to be heard by the North Dakota Supreme Court Nov. 17.
Gibbs was convicted in November 2007 of strangling the 22-year-old Valley City State University senior with her belt and cutting her throat with two kitchen knives in her apartment.

He lived in the same building and was arrested a week later. The 36-year-old is serving a life sentence without the possibility of parole for the conviction. He has repeatedly maintained his innocence.
