DEVILS LAKE -- A Lankin, N.D., man has been found guilty of assaulting and temporarily paralyzing a 2-year-old child.

Jurors delivered the guilty verdict for Austin Lee Thorsteinson, 25, around 6:30 p.m. Thursday at Ramsey County District Court on a Class A felony charge of child neglect. The jury was out for six hours after a nearly three-day trial that began Tuesday.

Thorsteinson was accused of striking a child’s head against a stereo speaker and metal table, causing a severe head injury that required emergency surgery, according to court documents. 

Thorsteinson went before a jury in November regarding the case. That ended in a mistrial when eight of the 12 jurors found him not guilty, which prompted the court to exclude evidence regarding the metal table.

A decision to acquit or convict must be unanimous, which happened Thursday.

Thorsteinson could be sentenced to a maximum of 20 years in prison. A presentencing investigation will be conducted before a sentencing hearing is set.
