GRAFTON, N.D.-A defense attorney asked Monday that a Grafton man accused of sexually abusing two young boys be evaluated to see if he is fit to stand trial.
Adam Lee Schnellbach, 31, was charged with four counts of gross sexual imposition, all Class AA felonies, and three counts of promoting sexual performance by a minor, all Class C felonies, in Walsh County District Court after a 4-year-old boy told his mother Schnellbach had sexually assaulted him, according to the criminal complaint.
Court papers allege Schnellbach also took lewd pictures of an 8-year-old boy.
Walsh County State's Attorney Barb Whelan said Schnellbach's defense attorney asked the judge at a hearing Monday for a competency evaluation of Schnellbach.
The evaluation will determine whether Schnellbach is able to understand the legal proceedings and participate in his own defense.
His next hearing is scheduled for 9 a.m. Feb. 11, 2016.
