The attorney for a man accused of texting while driving during a crash that killed a bicyclist in Traill County in June said his client has been demonized by the media. Defense attorney Kent Marshall appeared Wednesday with his client, Justin Ronald Jalbert, 26, of Grandin, in Traill County District Court. Jalbert faces manslaughter charges following the June 21 crash that killed 50-year-old David Hawkinson of Fargo on County Road 81. Court documents say Jalbert initially told a North Dakota state trooper he was reaching into the glove box to get a CD when he looked up too late to avoid Hawkinson on a bike about 10 yards ahead of him.
The North Dakota Attorney General’s Office said it will appeal a Dickey County judge’s order holding a state Bureau of Criminal Investigation agent in contempt of court. The proposed contempt order requires BCI Special Agent Arnie Rummel and the state of North Dakota to pay the owner of a payloader seized during a search warrant more than $48,000 after giving the payloader away without the court’s permission. BCI agents executed the search warrant on Darrell Schrum’s shop in Forbes on May 22, taking possession of a New Holland payloader they believed to be stolen, according to documents filed in Dickey County Court.

A Cass County deputy responding to a motorist that had crashed into a cow off Interstate 94 Monday morning had to go to the hospital himself after the injured cow charged him at the scene. Cass County Sgt. Dean Haaland said the deputy was responding to the crash at about 3 a.m. at mile marker 332 west of Casselton when the cow, injured in the crash, charged him. The deputy was knocked to the ground and suffered some bruising, Haaland said. When he got up, the cow charged again, and the deputy fired upon the animal to keep from being hit again, killing the cow.
An arrest warrant has been issued for a Moorhead woman accused of breaking into the home of her soon-to-be-ex-husband’s girlfriend and, with the help of several other people, beating up all the people who were there, including her husband’s girlfriend. According to criminal charges filed Friday in Clay County District Court, officers were en route June 15 to a disturbance call in the neighborhood near 1821 Belsly Blvd. They heard a commotion and saw debris at an apartment there, including a broken door jamb. All three people inside had visible injuries, court documents state, and a man was bleeding from the scalp on his left side and his right eye was starting to swell shut.
