Bismarck man sentenced to 14 years for killing brother
A Bismarck man has been sentenced in federal court to 14 years in prison for stabbing his brother to death on the Spirit Lake Indian Reservation in 2013.
Orlen Francis Smith Jr., 26, pleaded guilty to voluntary manslaughter and other assault charges in January.
According to a statement from the U.S. Attorney’s Office for North Dakota, Smith used a switchblade to stab his brother, Daniel Smith, in the heart during a fight in Daniel Smith’s home in St. Michael, N.D. Orlen Smith also attacked two others in the home, stabbing one in the arm and causing a laceration to the other’s forehead.
Judge Ralph Erickson sentenced Orlen, a member of the Three Affiliated Tribes of the Fort Berthold Indian Reservation, in U.S. District Court in Fargo.
Orlen has also been ordered to pay $11,436 in restitution and $300 to the Crime Victims Fund.
