Drug dealing charges dismissed for former UND football player
The most severe charge against a former UND football player after a drug task force raid on his Grand Forks home in May was dismissed Monday as part of a plea agreement, court records show.
Keelan Frederick Poole, 21, pleaded guilty Monday to two counts of misdemeanor drug possession and one count of misdemeanor drug paraphernalia. A Class B felony possession of marijuana with intent to distribute charge was dismissed, as were two other misdemeanors.
Poole was arrested May 11, when Grand Forks Narcotics Task Force officers executed a search warrant at his home and reportedly found cocaine residue, marijuana wax, about five grams of marijuana and a pipe. Officers also seized $3,655 in cash, which they said in an affidavit was a sign Poole might be trafficking drugs, though Poole said it was earnings from a summer landscaping job.
Task force officers said they'd received information that Poole was receiving bulk amounts of marijuana through the mail from his home state of Colorado. They seized a 500 gram scale they believed was used to weigh large amounts of marijuana, though Poole said he used the scale to measure portion sizes for his meals.
Poole's lawyer, Alexander Reichert, argued in court filings that the task force relied on outdated information and unreliable sources who cut deals with prosecutors in exchange for making statements against Poole.
Reichert said police also violated Poole's fourth amendment rights by trying to coerce him into unlocking his cell phone, a charge the State's Attorney's Office denied in a response brief.
Poole will receive no further jail time in the case. He was sentenced to 180 days in the Grand Forks County Correctional Center with 178 days suspended and received credit for two days he served after his May arrest. He will be on supervised probation for one year and must pay $325 in fines and fees.
It is unclear from court filings whether Poole was required to forfeit the cash seized from him during his arrest. His attorney did not immediately respond to requests for comment Tuesday.
Poole was dismissed from the UND football team following his arrest.
