Attorneys representing the NCAA and Fighting Sioux nickname backers who sued the association could present oral arguments before the 8th U.S. Circuit Court of Appeals by mid-October, according to scheduling documents submitted to the court.
Face it, the 1969 ceremony is a Johnny-come-lately to the settlement agreement. Spirit Lake did not see the sacred ceremony as an adequate response in 2007, else why did it schedule a vote in 2009?
That which already was sacred would hardly require a referendum.
North Dakota legislative leaders will meet Friday to consider retaining legal counsel to represent the Legislature in the Fighting Sioux nickname lawsuit at the state Supreme Court. Rep. Al Carlson, R-Fargo, the House majority leader and author of a law requiring UND to keep the nickname, said the interim Legislative Management Committee will meet by conference call at 2 p.m. from the Capitol.
The current “ND” is not unique, but the widespread logo with UND, containing the flame inside the D, has to be the only one of its kind.
Need we look any further for a logo? We already have it under our noses.

UND’s challenge will be to retire the nickname and logo honorably and gracefully, while the legal and political storms continue. Only that will guarantee UND’s standing among American universities on and off the field and on and off the ice.
The UND women’s team didn’t generate much offense during the weekend.
But one late burst Sunday afternoon allowed the Sioux to salvage one point out of the weekend with a 2-2 tie against Minnesota-Duluth in AmsOil Arena. The Bulldogs earned an extra point by winning the shootout 1-0.
Potato Bowl USA, a weeklong festival in which UND teams with the Red River Valley potato-growing industry, starts today and runs through Saturday, culminating in the Potato Bowl football game, UND vs. Black Hills State of Spearfish, S.D., in the Alerus Center.
University of North Dakota President Robert Kelley said Monday that events of recent days had persuaded him "to come right out and say" it's time to "move beyond" the UND nickname and logo issue and to repeal a new state law that has the university in "an impossible position."
