The ATV had two passengers at the time of the crash, and one was catapulted into the air and killed, North Dakota Highway Patrol officials said.

The ATV was traveling from Mercer to a residence in Brush Lake, officials said. The crash occurred about three miles north of Mercer near McLean County Road 33 and 8th Avenue Northwest at 3:15 p.m., according to a news release from Capt. Kyle Kirchmeier of the Highway Patrol.

The 49-year-old passenger who was killed was pronounced dead at the scene.

The other male passenger, a 49-year-old Pennsylvania resident, and the driver, a 48-year-old Fargo woman, were injured in the crash and taken to Sanford Health in Bismarck.

Charges against the driver are pending and the crash is still under investigation by the NDHP.
