1 dead, 1 facing criminal charges in tractor DUI crash in western ND
NEW ENGLAND, N.D. – A Dickinson man is dead and another is facing criminal charges after a tractor rollover near here early Friday morning.
According to officials with the North Dakota Highway Patrol, two cousins, Justin and Kyle Binstock, were headed west at about 1:40 a.m. Friday in a 2014 Challenger tractor on 51st Street Southwest about 2 miles west of Highway 22 and 9 miles north of New England.
The tractor, which Justin Binstock was driving, left the road and went into the south ditch, hitting a culvert and overturning.
Kyle Binstock, 29, was ejected from the tractor and pronounced dead on the scene, officials said.
Justin Binstock, 35, was charged with causing death while operating a vehicle under the influence of alcohol, a Class A felony, which carries a maximum penalty of 20 years in prison, a fine of $20,000, or both.
He was not injured in the crash and taken to the Southwest Multi-County Correction Center in Dickinson. Stark County State’s Attorney Tom Henning released him on his own recognizance Friday.
